Mr Roger Kaye KC

Deputy High Court Judge (Retired)

Mr Kaye KC is a retired Deputy High Court Judge with over 40 years of experience of helping to resolve disputes in a judicial or quasi-judicial role, whether as judge, arbitrator, mediator or investigator. His experience includes:

  • Retired Deputy High Court Judge with over 25 years of sitting at High Court level cases in all civil jurisdictions. Sat in all Divisions of High Court, including cases in (now) Business and Property Courts (Chancery, Commercial, Company, Banking, Mercantile, IT disputes, group litigation, and family finance).

  • Overseeing the case running in Competition Appeal Tribunal as chair of the UK Trucks Claim Limited SPV for dealing with claims by truck owners of trucks subjected to an unlawful cartel involving all major European truck manufacturers (as so found by European Commission).

  • Mediator and arbitrator of 15 plus years of experience.

  • Full working practice as QC for over 15 years.

  • Standing counsel to Crown.

  • Experience as Diocesan Chancellor for Dioceses of Hereford and St Albans over 20 years.

     

The Team

KP LAW

Mr Kaye KC has instructed the law firm KP Law to represent him in the claim. KP Law is a specialist law firm focusing on group action claims with market leading expertise in competition law.

Duncan Hedar is a Partner and Head of Competition at KP Law and heads the team at KP Law running the claim. A barrister and solicitor-advocate, he has extensive experience acting for clients in high-value and business-critical litigation and arbitration. This includes before the English High Court, the International Court of Justice, and numerous arbitral bodies.

Prior to joining KP Law, Duncan qualified as a solicitor at DLA Piper in 2014 before moving to Linklaters two years later.

Duncan was a founder of Lanier Longstaff Hedar & Roberts (LLHR), a UK claimant firm which targeted group legal actions such as pharmaceutical claims, product liability and competition liability. LLHR later merged to become KP Law.

This claim will be lead by Emma Bird, Partner. Emma has more than 15 years’ experience as a commercial litigator having trained and qualified at Squire Patton Boggs LLP. Throughout her career she has worked on large-scale, complex and high-profile claims across a variety of sectors. She has a particular specialism in competition litigation and has been litigating in the Competition Appeal Tribunal for more than 9 years. In that time, Ms. Birch has been significantly involved in the Truck Cartel litigation.

Mr Kaye KC has instructed Keystone as economic experts in the claim. Keystone is a global technology and advisory firm helping leading organisations tackle complex business, legal, and tech challenges.

Andrea Coscelli heads the team at Keystone working on the claim. Mr Coscelli is a Senior Partner in the London office and Head of Keystone’s practice in Europe. He is a leading European expert in antitrust and competition economics. His focus is on advising companies and government bodies on merger reviews, antitrust, litigation and regulation with a special focus on the digital economy.

Prior to Keystone, Andrea was the CEO of the UK Competition and Markets Authority (CMA) for six years until July 2022. He has over twenty-five years of competition economics experience and was awarded a Commander of the British Empire (CBE) for services to Competitive Markets in the 2020 New Year Honours. He led the CMA between 2016 and 2022 during a period of significant growth following the UK exit from the EU.

Michael Bowsher KC – Barrister at Kings Chambers

Michael Bowsher practices in public procurement, competition and commercial law, particularly in disputes concerning major public and public-private projects. He is particularly known for his unique practice in regulated procurement in the United Kingdom, Ireland, elsewhere in Europe and beyond.

Michael Bowsher KC has appeared as counsel in many of the major procurement cases over more than a decade. His contentious practice is complemented by a substantial practice in providing legal and strategic advice for bidders and purchasers throughout the procurement process.

Michael remains very active in competition law matters, having acted in a number of recent matters involving essential facilities, competition in payment systems and now acting as leading counsel in a number of collective proceedings brought in the CAT.

Nicholas Khan KC – Monkton Chambers

Nicholas Khan KC practices in competition law following his return to full time private practice after a long career as a member of the Legal Service of the European Commission, marked by being the only lawyer to have taken Silk while working in a European Union institution.

As a member of the Commission’s Legal Service, Nicholas advised on many areas of EU law and represented the Commission in hundreds of cases before the EU Court of Justice and also in a number of interventions before the English Courts in State aid and Competition cases.

Nicholas has appeared in many cases that have been fundamental to the development of EU law including cases against Google such as (Google Shopping, T-604/18 and C-738/22 P Google Android, and T-334/19 Google AdSense).
